The Beginnings of the Volkswagen Recall for US Consumers

In September, the EPA and the California Air Resources Board discovered software in several Volkswagen vehicles going back to 2009 that purposely ran the engines at lower power to decrease emissions of nitrogen oxide and overstate fuel efficiency when the vehicles were in test conditions. On the road, some vehicles reportedly emitted nitrogen oxide, which is harmful to both humans and the environment, at rates 40 times greater than what is allowed under federal law.

To clarify since the late revelation of additional vehicles tampered with by VW and Audi, the vehicles that are included in the proposed Volkswagen recall involving 488,000 US clean diesel vehicles in non-compliance with the EPA to date now in 2016 include:

  • Any 2009 to 2015 model year Audi A3, VW Beetle, VW Golf, or VW Jetta clean diesel brand vehicles containing the two (2.0) liter TDI engine contain emissions defeat software configurations and on their own, are not compliant with US or California emissions laws
  • Likewise, any 2009 to 2015 VW Beetle Convertible or VW Jetta Sportwagen containing the two (2.0) liter TDI, clean diesel engine also containing emissions defeat testing software and in practice grossly exceeds EPA regulatory limits for NOx emissions
  • Finally, any 2015 VW Golf Sportwagen with the same two (2.0) liter TDI clean diesel engine also will contain emissions defeat software configurations permitting the vehicle’s sale in the US

Volkswagen Recall Models and Makes Involved Now Includes New Vehicles:

  • Defeat devices were later revealed being present by EPA regulators in VW Touareg cars with the model year 2014
  • Regulators also noted the existence of the 2015 Porsche Cayenne diesel type engine also containing the emissions defeat device in order to meet EPA regulatory standards
  • Additionally, regulators and Audi both noted that the majority of any Audi Quattro vehicles with a diesel engine imported for sales as 2016 models contain the emission defeat software

What Has Happened in the Volkswagen Recall Since September of 2015?

In the ensuing days since the scandal broke, consumers and legal professionals, as well as many company representatives from VW and Audi, remain even less clear concerning the project future Volkswagen recall process.

  • In later developments moving into 2016, VW Group offered all current US recall affected products refunds of the amount of $1000 in a voucher, while continuing to encourage trade-ins from owners ostensibly enticed to return based on the $2,000 compensatory payment offered by VW on top of all trade in pricing.
    A month afterwards, the VW executives publicly stated that nearly twenty-five (25%) percent of owners had agreed to accept the offers. Moreover, the company has promised additional compensatory type payments to owners for resale value losses in vehicles, arguably the strongest financial losses claim of any impacted vehicle owner, albeit one that is coupled with extensive fraud and most likely criminal conduct.
  • US domestic resale values did decrease nearly a quarter of the prior year value in many instances of VW and Audi clean diesel vehicles, at least in US markets, whereas VW’s public image disaster recovery efforts have spurred a buying rush from consumers in wealthier East Asian countries.
  • In the latest on the Volkswagen Recall in the United States, consumers face further delays, unfortunately, as the California Air Regularity Board conceded to an extension of a deadline it has previously imposed on VW and Audi to produce a plan to resolve claims that later entailed a Volkswagen crafted proposal received, but still under review by the CARB and the EPA for the past month. Moreover, at this juncture, EPA and CARB’s requests to Volkswagen and Audi for an additional three weeks to review the terms of the originally submitted proposal remains ongoing.
  • In November, Volkswagen submitted a recall plan to the California Air Resources Board that would repair the emissions issues in its vehicles in the state. The plan will be approved following consultation with the EPA so that it can work in tandem with a national recall effort. So far exact details of the recall plan haven’t been announced to the public yet, and representatives of the California Air Resources Board say those details won’t be forthcoming until all parties appear satisfied with the plan to offer to consumers. In the meantime, legal action against VW and Audi continues by hundreds of husbands of former and current owners or lessees of VW and Audi clean diesel owners.

When Will the Volkswagen Recall Start?

Realistic timelines emanating from multiple sources and often confirmed off record by VW or Audi employee state that recall repair work for simple software updates will not commence until as late as 2017, with proposed methods of recall repair being complicated by differing approaches to differing vehicle brands, model years, and makes.
